Joe Biden’s Border Patrol chief is now questioning and criticizing Biden’s policies that are leading to “no consequences” for illegal immigrants crossing into the United States.
Chief Raul Ortiz testified under oath on July 28 as a part of discovery in a lawsuit by Florida Republican Attorney General Shelby Moody against Joe Biden’s Department of Homeland Security.
Ortiz, a 31-year law enforcement veteran, told attorneys representing the State of Florida, that illegal immigration will increase at an exponential rate at the Southern border. There are “no consequences,” he said for illegal immigrants crossing into America.
“In my experience, we have seen increases when there are no consequences,” he said during his deposition.
So, if migrant populations believe that they’re going … there are not going to be consequences, more of them will come to the border. Is that what you’re saying?” The Florida attorney questioned.
Ortiz responded, “There is an assumption that if migrant populations are told that there is a potential that they may be released, that, yes, you can see increases.”
“So, it will increase at an exponential rate. Is that what is being suggested here?” The attorney asked.
Ortiz said he did think it would increase.
Later on, the attorney asked, Since President Biden was elected, does this document indicate that aliens illegally entering the United States perceive that they will be able to enter and remain in the United States?”
She was referring to the Spring 2021 memo that revealed that Biden’s immigration policies are fueling the uncontrollable migrant surge at the southern border.
Ortiz said yes, the immigrants believe they will be able to remain in the U.S.
Moody’s lawsuit against the Department of Homeland Security cites this memo as well as Biden’s November 2021 “Alternatives to Detention” document. This is a U.S. Customs and Border Protection memo that details the Biden administration and encouraged illegal immigrants to cross the southern border of the U.S.
“The Biden administration caused the surge, made the border less safe and is flagrantly violating the very federal laws they swore to uphold. The Biden administration is putting hard-working border patrol agents in impossible and untenable positions — risking their lives and safety, and I want to thank Chief Ortiz for testifying truthfully at his deposition,” Moody told Fox News Digital.

The questioning of Ortiz focused on a spring 2021 memo that said the Biden administration’s immigration policies prompted the surge of migrants crossing the southern border.
The DHS memo, shared by Moody’s office with Fox News Digital, named “perceptions of favorable U.S. immigration policies” as one of the driving factors for the influx of migrants at the border.
In her lawsuit, Moody cites that memo and an administration “Alternatives to Detention” directive from November 2021 to the US Border Patrol about how to handle migrants as factors making the border less safe for Americans.
The suit claims that immigration agencies in the Biden administration are not following established federal law — the Immigration and Neutrality Act — requiring officials to hold migrants at the border until they can be sent back to their home countries.
Moody’s lawsuit is set for trial in January 2023, in the U.S. District Court for the Northern District of Florida.
