Senator Lindsey Graham has been ordered to testify before a special grand jury later this month, by a judge in Fulton County, Georgia.
Graham was one of eight people subpoenaed by the jury, which is asking for testimonies into the alleged criminal interference in the 2020 election results in the county.
Graham first said he would fight the subpoena.
The presiding Fulton County Superior Judge Robert McBurney said that Graham is a “necessary witness” to the investigation, so he must testify.
The grand jury needs to hear about two phone calls between Graham and Georgia’s Secretary of State, Brad Raffensperger.

Graham allegedly told Raffensperger he should consider reexamining certain absentee ballots cast in Georgia to explore the possibility of a “more favorable outcome for former President Donald Trump,” whose loss in Georgia was a critical blow to his attempt to win reelection.
The grand jury also subpoenaed former Trump attorney Rudy Giuliani and several others who were fighting the outcome of the 2020 election in Georgia and elsewhere. Fulton County became a national center of attention following accusations that massive voter fraud had taken place there.
Fulton County District Attorney Fani Willis says it is her hope that Graham “will have a moment of quiet reflection and decide to bring truthful testimony before this grand jury that wants to hear from him on some very important issues.”
The senator is ordered to testify on Aug. 2, but the subpoena must work its way through courts in Washington, D.C., which may be a lengthy process.
Lindsey Graham told Politico:
“We will be going to court,” he told us following the judge’s order.
Sen. Lindsey Graham (R-S.C.) told POLITICO on Tuesday he would continue to fight a subpoena out of Georgia, even after a judge ruled earlier this week that the senator must appear.

It is now being reported that GOP Senator Lindsey Graham is telling Fulton County District Attorney Fani Willis to pound sand and said he will fight the subpoena by the Fulton County grand jury she impaneled to look into former President Donald Trump’s actions in Georgia after losing the 2020 election.
The grand jury’s subpoena to Graham says: “During the telephone calls, the Witness questioned Secretary Raffensperger and his staff about reexamining certain absentee ballots cast in Georgia in order to explore the possibility of a more favorable outcome for former President Donald Trump.”
Graham’s attorneys Bart Daniel and Matt Austin from Nelson Mullins Riley & Scarborough LLP issued a statement that said: “As Chairman of the Senate Judiciary Committee, Senator Graham was well within his rights to discuss with state officials the processes and procedures around administering elections.
