After massive bipartisan pushback and a series of court rulings, the Occupational Safety and Health Administration (OSHA) has now officially suspended the enforcement of Joe Biden’s vaccination mandate for private companies. This mandate was scheduled to be enforced starting January 4, 2022.
“On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit granted a motion to stay OSHA’s COVID-19 Vaccination and Testing Emergency Temporary Standard, published on November 5, 2021 (86 Fed. Reg. 61402) (“ETS”). The court ordered that OSHA ‘take no steps to implement or enforce’ the ETS ‘until further court order, while OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.” the OSHA website states.
After 27 states joined to file a lawsuit against the Biden Administration along with supply chain groups and other private entities, the Fifth Circuit Court of Appeals has issued a temporary stay on the tyrannical Biden policy stating “grave statutory and constitutional issues.”
After the Court’s decision, Texas Attorney General Tweeted: “🚨Citing Texas’s “compelling argument[s],” 5th Circuit has stayed OSHA’s unconstitutional & illegal private-business vaccine mandate. WE WON! Litigation will continue, but this is a massive victory for Texas & FREEDOM from Biden’s tyranny & lawlessness.”
Louisiana Attorney General Jeff Landry also expressed his views in a tweet: “In a major win for the liberty of job creators and their employees, the United States Court of Appeals for the Fifth Circuit just halted the Biden Administration’s attempt to force vaccines on businesses with 100 or more workers.”
