
Pennsylvania Democrat Governor Tom Wolf’s acting health secretary imposed mask mandates for school children without legal authorization.
on Friday, the Pennsylvania Supreme Court ruled to remove these illegal unconstitutional mandates.
According to ABC 6, “The practical impact of the decision will depend on which schools and school districts impose their own masking requirements,”
The court ruled that the Democrat acting state health secretary, Alison Beam, did not possess the authority to require masks, and failed to follow state legislation regarding enacting regulations, and acted without an existing disaster emergency declared by the governor in place.
Pennsylvania’s disease control law does not give health secretaries “the blanket authority to create new rules and regulations out of whole cloth, provided they are related in some way to the control of disease or can otherwise be characterized as disease control measures.” According to the ABC 6 report.
This comes after two Republican state lawmakers, Senate President Pro Tempore Jake Corman, and Rep. Jesse Topper filed a lawsuit along with two religious schools, three public school districts, and multiple parents of school children.
Litigations of this lawsuit challenged Beam’s actions and argued that this mandate did not allow the public to voice their opinion and ultimately violated the state law.
