A Special Master is a person appointed by a court to oversee litigation or part of a case and ensure both parties abide by a judge’s orders. For instance, they may address matters that can’t be efficiently handled by an available district judge or magistrate judge of the district.
They are often similar to an arbitrator who is a person unions typically agree to hear their dispute and make an informed decision. It removes the need for a judge to perform the same duties because the judicial system is overloaded and overworked.
A majority of the time, an arbitrator or a special master is preferred because the person makes the informed decision based on the facts of the case. The person does not rely on legal precedent to determine the outcome of any particular matter.
District Court Judge Aileen Cannon of the Southern District of Florida is weighing the decision to assign a special master based on submissions from the former President’s attorneys and “the exceptional circumstances presented,” Fox News reported.
President Trump’s attorneys believe a special master is needed because some of the documents taken during the search are presumptively privileged because they entail presidential communication, and they believe the FBI can’t be trusted to protect his rights, according to MSN.com.
Judges prefer the practices of arbitration and a special master because all parties involved agree to abide by the decisions made ahead of time. There will be no appeal of the decision made or arguing why it was made.
The parties involved usually agree to this process because the appointed person does not have political connections or strong ones. In general, all parties involved feel the process is fair and objective.
It is hard to believe that the person appointed as Special Master will not have a political connection to this case. Everyone does in one way or another. Whoever is appointed, will have the job of reviewing the documents the FBI seized and determining the classification level.
During their early morning raid into his Mar a Lago home, the FBI took 20 boxes of items from the premises. The documents included one set of documents marked as “Various classified/TS/SCI documents,” which refers to top secret/sensitive compartmented information according to the property receipt.
Justthenews.com reported earlier that President Trump had a standing order that documents taken from the Oval Office because people were continuing to work on them, were immediately declassified. The standing order was part of an Executive Order established by President Obama.
The Biden Administration is happy to focus on the documents and whether or not they should be classified. It takes away the fact the raid should never have happened in the first place and that it was done to politically damage the Democrat’s likely opponent in 2024.
This past week, the Affidavit was released that would provide the probable cause necessary for the Judge to sign off on the search warrant. As expected, the document was one long redaction line that blacked out nearly every line of the Affidavit.
The political fight between Trump and the Democrats is only heating up. The mid-term elections are less are 72 days away. We have ten weeks to prepare for perhaps the election of our lifetime.
If the Democrats win on November 8th, they will turn our political system into a one-party ruling government and turn us into Venezuela. If the Republicans win, there will be reform and change that will finally listen to the people.
