Somehow, everything is aligning, and all signs point that the recently confirmed Republican presidential nominee, former President Donald Trump, will win the upcoming election.
After surviving a killing attempt, the MAGA leader delivers another major blow to the entire deep state: Judge Aileen Cannon ruled that Jack Smith’s appointment was illegal after all and dismissed the DOJ’s sham classified case.
The decision came a few hours after the Republican National Convention in Milwaukee, Wisconsin, commenced.
Trump’s attorneys argued that Smith’s appointment was unconstitutional because the Senate did not confirm his position, nor was he a US attorney when appointed. Therefore, the Justice Department illicitly funded his prosecution of the former president.

In her opinion, Judge Cannon stated:
“In the end, it seems the Executive’s growing comfort in appointing “regulatory” special counsels in the more recent era has followed an ad hoc pattern with little judicial scrutiny.”
“Perhaps this can be traced back to reliance on stray dictum in Nixon that was perpetuated in subsequent cases. Perhaps it can be justified practically by the urgency of national crises. Or perhaps it can be explained by the relative infrequency of these types of investigations, by congressional inattention, or by the important roles that special-counsel-like figures have played in our country’s history. Regardless of the explanation, the present Motion requires careful analysis of the statutory landscape to ensure compliance with the Constitution, and the Court has endeavored to do so with care.”
Cannon explained that the Court had to return to “where it started, citing the Appointments Clause, which is “among the significant structural safeguards of the constitutional scheme.”
She argued, “Special counsel Smith’s use of a permanent indefinite appropriation also violates the Appropriations Clause, U.S. Constitution, but the court need not address the proper remedy for that funding violation given the dismissal on Appointments Clause grounds.”
Cannon, in her explanation, cited an opinion on the case of Boyd v United States, reiterating that unconstitutional practices come “by silent approaches and slight deviations from legal modes of procedure.”
Trump hailed the decision in a Truth Social post and called for the courts to dismiss all other sham charges against him.
“As we move forward in Uniting our Nation after the horrific events on Saturday, this dismissal of the Lawless Indictment in Florida should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts — The January 6th Hoax in Washington, D.C., the Manhattan D.A.’s Zombie Case, the New York A.G. Scam, Fake Claims about a woman I never met (a decades-old photo in a line with her then-husband does not count), and the Georgia ‘Perfect’ Phone Call charges. The Democrat Justice Department coordinated ALL of these Political Attacks, which are an Election Interference conspiracy against Joe Biden’s Political Opponent, ME. Cannon’s decision was another legal victory for the Republican nominee after the Supreme Court’s verdict on presidential immunity from prosecution.
However, lawyers for Trump expect prosecutors to appeal the ruling.
