JUST IN: Federal Judge Blocks Trump’s Birthright Citizenship Ban, Setting Up Major Legal Showdown

A federal judge in New Hampshire has issued a preliminary injunction halting President Donald Trump’s executive order that sought to end birthright citizenship for infants born to undocumented immigrants or parents without legal status in the United States.

U.S. District Judge Joseph LaPlante handed down the decision Thursday, granting nationwide class certification to all infants affected by the order while explicitly excluding parents from the case. The judge stated he would issue a written opinion later in the day detailing the legal basis for his ruling.

In his brief remarks, Judge LaPlante cited the 14th Amendment and the potential for “irreparable harm” resulting from the deprivation of citizenship to U.S.-born infants. The ruling effectively blocks federal agencies from enforcing Trump’s directive, which instructed them to deny citizenship documentation to children unless at least one parent is a U.S. citizen or lawful permanent resident.

The controversial executive order was signed on the first day of Trump’s second term and marked a major departure from over a century of legal precedent upholding birthright citizenship.

Legal experts say the case is now poised for a swift appeal from the Trump administration. The Supreme Court, which previously declined to weigh in directly on the birthright citizenship issue, ruled 6–3 last month that any plaintiffs seeking nationwide relief must file their cases as a class action—a requirement that has now been met in this case.

Thursday’s ruling represents a critical early test of the judiciary’s willingness to check executive power in Trump’s second term, and may eventually set up another high-stakes Supreme Court battle over constitutional protections and immigration policy.
