A Manhattan judge ruled in favor of New York City’s largest police union and decided that New York City’s vaccine mandate is invalid.
The judge also ordered that all Police Benevolent Association members who were terminated or put on leave without pay as a result of non-compliance be reinstated.
State Supreme Court Justice Lyle Frank wrote:
“In support of its contention that the DOH Commissioner can unilaterally create employment conditions, respondents cite to holdings of recently decided federal cases and trial court decisions.”
“This argument too is unpersuasive.”
“Respondents cite a multitude of cases where this Court, as well as others, have denied petitions based on vaccination being a condition of employment, however in those instances the City and the respective union collectively bargained to include the vaccination mandate as a new condition of employment, that is not the case here.”
Former White House COVID response coordinator Dr. Deborah said that she “knew” COVID-19 vaccines “were not going to protect against infection.”
And yet, she said this after too many people lost their jobs and livelihoods because of the ineffective vaccine.
The PBA issued a statement:
A Manhattan state Supreme Court judge ruled today that New York City’s vaccine mandate is invalid as applied to PBA members and has ordered that all PBA members who were terminated and/or put on leave without pay as a result of non-compliance be reinstated.
The PBA’s President Patrick Lynch commented on the move and said, “The vaccine mandate was an improper infringement on our members’ right to make personal medical decisions in consultation with their own health care professionals.”
“We will continue to fight to protect those rights.”
After the ruling, the city’s law department immediately appealed the ruling.
They said, “It is at odds with every other court decision upholding the mandate as a condition of employment.”
The fact that we are still talking about COVID-19 towards the end of 2022 is insane, but what do you expect from an insane world?
Remember when healthcare workers were heroes and then suddenly if they weren’t vaccinated they were fired? They were fired even though the demand for healthcare professionals was increasing. yeah, makes a lot of sense.
At the beginning of 2022, Mayo Clinic fired about 700 employees who did not comply with the COVID-19 policy.
“Nearly 99 percent of employees across all Mayo Clinic locations complied with Mayo’s required Covid-19 vaccination program by the Jan. 3 deadline,” the clinic said of its staff, which consists of around 73,000 workers.
The Mayo Clinic said approximately 1 percent of its staff, or around 700 people, would be “released from employment.”
This recent ruling for the PBA is a promising move in the right direction after the complete insanity of the pandemic.
