Rep. Stefanik Demands Judge Merchan Investigated for Misconduct

Judge Juan Merchan’s (mis)handling of Donald Trump’s trial in New York won’t go unnoticed as Rep. Elise Stefanik promptly filed a misconduct complaint against him, as she argued that the selection of Merchan to preside on Trump’s case is “not random at all.”

On Tuesday, the House Republican Conference chairwoman sent a letter addressed to the inspector general of the New York State Unified Court System demanding to immediately conduct a probe on Justice Merchan “to determine whether the required random selection process was followed.”

“One cannot help but suspect that the ‘random selection’ at work in the assignment of Acting Justice Merchan, a Democrat Party donor, to these cases involving prominent Republicans, is in fact not random at all,” Stefanik wrote.

The lawmaker also sent the letter to the New York State Commission on Judicial Conduct.

Stefanik cited how Merchan repeatedly handled cases involving Trump and his associates, including a 2022 case involving Trump and the New York City, accusing Trump of tax fraud.

“The simple answer to why Acting Justice Merchan has been assigned to these cases would seem to be that whoever made the assignment intentionally selected Acting Justice Merchan to handle them to increase the chance that Donald Trump, the Trump Organization, and Steven Bannon would ultimately be convicted,” Stefanik argued.

Stefanik, who is among the names eyed to be Trump’s running mate, hopes that if Merchan or other justices violated assignment guidelines, she hopes the “Commission would subject them to the required discipline.”

The New York representative filed her motion in time for the closing arguments of Trump’s bogus hush money trial.

Last week, the New York lawmaker also slapped Merchan with an ethics complaint, believing there is a conflict of interest for the presiding judge as his daughter plays a role at a firm that has been staunchly supportive of the Democrats.

She filed the motion with the New York State Commission on Judiciary Conduct. The lawmaker warned that if the jury convicted Trump, not only are his “interests at stake” but “the interests of all Americans are at stake.”

“This private caution has not deterred Judge Merchan’s judicial misconduct, as evidenced by this current complaint.”

“Judge Merchan appears driven by Democrat partisanship and financial gain for his daughter,” Stefanik blasted.

Stefanik further quipped that it is “imperative that New Yorkers and all Americans have confidence that justice is being dispensed fairly in New York.”
