
Donald Trump and his legal team had repeatedly warned U.S. Supreme Court justices to avoid “haste” as Special Counsel Jack Smith demanded them to rapidly discuss the former president’s immunity claim appeal.
Trump’s attorney wrote: “In an omission that speaks volumes, the Special Counsel never explains why March 4, 2024, is supposedly the only ‘appropriate timetable’ for this historic prosecution.”
“That date has no talismanic significance.”
Many believe that Smith’s urgency comes from the prosecutor’s desire to convict Trump before the 2024 presidential election and derail his campaign, in the guise of “public interest”.
“Instead, he vaguely asserts that the ‘public interest’ favors resolution on a dramatically accelerated timetable, to ensure that President Trump may be brought to trial in the next few months,” Trump’s attorneys wrote.
“In doing so, he confuses the ‘public interest’ with the manifest partisan interest in ensuring that President Trump will be subjected to a months-long criminal trial at the height of a presidential campaign where he is the leading candidate and the only serious opponent of the current Administration.”
U.S.District Judge Tanya Chutka, the trial judge presiding over the case had dismissed Smith’s appeal and said that ” [urgency for a speedy trial] is a vindication of the nation’s criminal justice system that should be untethered from concerns about the political calendar that should be untethered from concerns about the political calendar.”
The special counsel’s failure to disclose the reason behind his demand for speedy trial only reveals his true motivation and that is to destroy and derail Joe Biden’s top rival for the presidential elections.
“The Special Counsel’s extraordinary request, combined with its vague, threadbare justification, creates the compelling appearance of a partisan motivation: To ensure that President Trump — the leading Republican candidate for President, and the greatest electoral threat to President Biden — will face a months-long criminal trial at the height of his presidential campaign,” said the GOP leaders’ legal team.
According to Trump’s 44-page filing, his team urged the justices to allow the D.C. Circuit Court of Appeals to discuss the immunity issue first. His lawyers elaborated that the court has already set an expedited schedule to receive legal arguments on the issue, which might end up back at the Supreme Court within a few weeks.
They described Jack Smith’s appeal as “reckless abandon.” Smith initially proposed that the SC skip the appeals court.
Trump’s lawyers added that Smith had no authority to seek Supreme Court review in the first place because Judge Chutkan had already decided in Smith’s favor.
