
Liberals receive another slap as the Supreme Court rejects their move to disqualify former president Donald Trump from Michigan’s primary ballot in 2024.
On Wednesday, December 27, the Michigan Supreme Court countered a recent Colorado Supreme Court decision that removed Trump from Colorado’s primary ballot.
The leftist Free Speech for People (FPSP) filed the lawsuit in September in Michigan. They also failed to get a positive outcome in their case against Trump in Minnesota.
Michigan’s lower courts had earlier dismissed their lawsuit based on a lack of procedural grounds. The Michigan SC said that it was not “persuaded that the questions presented” should be reviewed by that court.
The Michigan Court of Claims heard three oral arguments for three lawsuits last November: two legal complaints questioning Trump’s qualification for candidacy, a lawsuit against Michigan’s Secretary of State Jocelyn Benson for attempting to block Trump on the state’s ballot, and a third complaint filed by the GOP leader against Benson.
After being rejected by the local court, the FPSP appealed their lawsuit to the Michigan Court of Appeals, where they received a unanimous 3-0 opinion that their plaintiff was “not ripe” on procedural grounds.
The order further stated that it does not prevent voters from questioning Trump’s eligibility if the leading Republican primary nominee wins. The court hopes that by then, the US Supreme Court may have a definitive decision on the issue.
Trump acknowledged the Michigan SC order on Wednesday.
“The Michigan Supreme Court has strongly and rightfully denied the desperate Democratic attempt to take the leading candidate in the 2024 presidential election, me, off the ballot in the Great State of Michigan,” the MAGA leader said on Truth Social.
“This pathetic gambit to rig the election has failed all across the country, including in states that have historically leaned heavily toward the Democrats. Colorado is the only state to have fallen prey to the scheme.”
Michigan has a distinctive process for candidates’ selection for the presidential primary ballot. The secretary of state is tasked with enlisting candidates “generally advocated by the national news media to be potential presidential candidates.” However, political parties are also allowed to submit their list of candidates and petition names they wish to add.
The Michigan Court of Appeals clarified this in their ruling on the lawsuit against Benson and said that “the Secretary of State’s role in presidential primary elections is chiefly that of an administrator.”
“In particular, when it comes to who is or is not placed on the primary ballot, the statutory scheme leaves nothing to the Secretary of State’s discretion.”
Michigan’s primary election is set for February 27.
