Family, Judicial Watch Prosecute FBI for Ashli Babbitt’s Shooting Case ‘Cover-Up’

On behalf of Ashli Babbitt’s husband, Aaron Babbitt, watchdog group Judicial Watch demands the Federal Bureau of Investigation to grant access to Babbitt’s legal team through a Freedom of Information Act lawsuit they charged against the Department of Justice.

Ashli Babbit is a US Air Force veteran who was murdered inside the US Capitol by former Capitol Police Lt. Michael Byrd on January 6, 2021.

The filing was made on Friday at the US District Court for the Southern District of California.

The watchdog group calls on the FBI to turn over all information they were able to obtain about the Babbitts and reports of the Air Force veteran’s shooting and death outside the House Speaker’s Lobby.

According to Judicial Watch, then-Capitol Police Lt. Michael Byrd was even promoted after he killed Babbitt.

The group also filed a $30 million wrongful death lawsuit against the federal government, whom they murdered amid the FBI-led violence.

“The FBI has failed to produce the requested records or demonstrate that the requested records are lawfully exempt from production, or notify plaintiffs of the scope of any responsive records they intend to produce or withhold and the reasons for any withholdings,” the filing said.

Judicial Watch also accused the FBI of cover-up during their filing after the federal authorities declined their demands for the documents they have on Ashli and her husband Aaron.

Judicial Watch President Tom Fitton told on January 4, during the filing of the suit, that “[the] Judicial Watch and our supporters are honored to represent Ashli’s steadfast widower Aaron Babbitt and her estate in this legal action. Ashli was shot in cold blood, and the rule of law requires justice for her.”

Fitton also blasted the FBI for hiding Ashli Babbitt’s files from her family, “Ashli Babbit was the only homicide victim on Jan. 6, yet the FBI has been illicitly hiding its files on Ashli Babbitt from her family for a year. Why the cover-up?”

In the wrongful death suit filed by Ashli’s family, they filed new video evidence that reveals an unarmed Babbitt being pushed into the House Speaker’s Lobby as the then-Lt. Byrd aimed his gun. As he fired his gun, Ashli fell from her back, bleeding from the shoulder and neck.

The suit furthered, “Ashli remained conscious for minutes or longer after being shot by Lt. Byrd. Ashli experienced extreme pain, suffering, mental anguish, and intense fear before slipping into pre-terminal unconsciousness. The autopsy report identified the cause of death as a ‘gunshot wound to left anterior shoulder’ with an onset interval of ‘minutes.’ The fact that Ashli was alive and conscious in extreme pain and suffering is documented in videos of the shooting.”

Ashli’s family further pressed that she was alive and breathing after being shot. She was declared dead upon arriving at Washington Hospital Center.

“Furthermore, nothing about the wound track described in the autopsy report would be expected to result in immediate death or instantaneous loss of consciousness, and Ashli’s lungs contained blood, further confirming that she was alive and breathing after being shot. Ashli was pronounced dead at Washington Hospital Center at 3:15 p.m. The medical examiner determined that the manner of death was homicide.”

Byrd, Ashli’s murderer, claims it was his “last resort” and had been promoted to captain.
