NEW: Schiff Sets Up Legal Defense Fund Amid Intensifying Fraud Investigation

Senator Adam Schiff (D-Calif.), a prominent figure in Democratic politics and a vocal critic of President Donald Trump, has established a legal defense fund as the Department of Justice (DOJ) intensifies its investigation into allegations of mortgage fraud tied to his real estate dealings. The fund, named the Senator Schiff Legal Defense Fund, was registered with the Internal Revenue Service on Thursday, signaling Schiff’s preparation for a potentially protracted legal battle.

The investigation, led by special prosecutor Ed Martin—appointed by Attorney General Pam Bondi on August 8—centers on claims that Schiff misrepresented a Maryland property as his primary residence to secure more favorable loan terms, while simultaneously claiming a Burbank, California, condo as his primary residence for tax benefits. The allegations, first referred by Federal Housing Finance Agency (FHFA) Director Bill Pulte to the DOJ in May, suggest that Schiff falsified bank documents and property records between 2003 and 2019, affecting loan payments for a Potomac, Maryland property. A Fannie Mae memo reportedly cited a “sustained pattern of possible occupancy misrepresentation” in connection with five loans.

Schiff, who has denied any wrongdoing, has characterized the probe as a politically motivated attack orchestrated by Trump and his allies. “It’s clear that Donald Trump and his MAGA allies will continue weaponizing the justice process to attack Senator Schiff for holding this corrupt administration accountable,” said Marisol Samayoa, a spokesperson for Schiff, in a statement to Fox News. “This fund will ensure he can fight back against these baseless smears while continuing to do his job.”

The allegations come amid Schiff’s long-standing feud with Trump, dating back to his tenure in the U.S. House of Representatives. As a key figure on the House Intelligence Committee, Schiff led the first impeachment inquiry against Trump in 2020 and later served on the committee investigating the January 6, 2021, Capitol riot. Trump has repeatedly targeted Schiff, most recently calling for his prosecution over the mortgage fraud claims and accusing him of promoting the “Russia hoax” during the 2016 election investigations. In a Truth Social post, Trump alleged that Schiff “engaged in a sustained pattern of possible Mortgage Fraud”—a claim Schiff has dismissed as “transparently false, stale, and long debunked.”

Legal experts have questioned the likelihood of a successful prosecution. Cornell Law School Professor William Jacobson noted that the DOJ would need a robust paper trail to build an airtight case, given that the statute of limitations for most federal financial fraud crimes is 10 years—and Schiff’s last allegedly false statement was made in 2013. Additionally, venue challenges in liberal-leaning jurisdictions such as Maryland, Washington, D.C., or California could complicate efforts to secure a conviction. “The one thing they don’t want to do is to bring a case that fails,” Jacobson told Fox News Digital.

The creation of the legal defense fund has sparked mixed reactions. Supporters view it as a necessary step to counter what they see as politically motivated attacks, while critics—including some X users—have framed it as an admission of guilt. One post on X stated, “Schiff is setting up a legal defense fund because he’s knee-deep in financial trouble,” reflecting skepticism about his motives. However, these claims remain speculative, and no charges have been filed as the grand jury in Maryland continues to deliberate.

As the investigation unfolds, Schiff remains focused on his Senate duties, with his team emphasizing his commitment to serving Californians. The outcome of the DOJ probe could carry significant implications for Schiff’s political future, particularly given his high-profile role as a Trump antagonist and his recent election to the Senate in 2024.
