Senator Kelly and Senator Sinema, what do they have in common? They are both Senators of Arizona. They are both democrats, and the two voted “Yes” for on the bill S. 2938, which was signed into law by Former Vice President Biden.

The Democrats’ recent play on words was titling the S. 2938 bill as the “Safer Communities Act.” Now when one hears “Safer Communities,” it sounds good. The red flag laws also carry the same notion. But don’t be fooled by these trojan horses. Unfortunately, this is one of the Democrats’ unique gifts. They manipulate your sensibility into siding with them, tricking you that they offer you better security at the cost of your unalienable rights.

Luckily for Arizona, there is a candidate in the governor’s race who will fight against the unconstitutional laws of S. 2938. Kari Lake, endorsed by President Donald Trump, tweeted, “When I’m Governor, Arizona will not recognize unconstitutional Gun Laws in our state. We just won’t do it.”

The recent signing of S. 2938 into law should be alarming to all U.S. citizens, regardless of whether you are a gun owner or not. Red flag laws, no matter how rational they may sound on the surface, are unconstitutional in practice. If the people of Arizona what to keep their rights and have the right to defend what is theirs, they need leaders like Kari Lake to protect their rights.

Why are Red flag laws unconstitutional?

On the surface, mentally ill people shouldn’t have access to firearms. That is reasonable in itself. Many would agree with that. But who gets the power to flag others? Doctors, teachers, neighbors, ex-boyfriends, or girlfriends?

What does the bill itself say? According to an article written by Camille C. Knox on CBS News:

“The bill enhances background checks for gun buyers 21 years of age, provides billions for mental health services and closes the so-called “boyfriend loophole” to prevent convicted domestic abusers from purchasing a firearm for five years. In addition, the plan provides $750 million in grants to incentivize states to start crisis intervention programs, clarifies the definition of a federally licensed firearms dealer and creates penalties for straw purchases and gun trafficking.”

So how does this bill change straw purchases? What is a straw purchase? Straw purchases, a phrase that has been interchangeable with “gun show loophole,” penalties for such things already exist. Usually, these happen privately between family members. They are not what leftists claim; you can go online or to gun shows and transfer your firearms to whomever you please. Despite S.2938, transfers are still legal to do with a bill of transfer.
Let’s say a father gifts a son an old rifle, but the son can not legally own that rifle. It is already illegal for the father to gift the son a rifle if the son was or is a felon. So, in other words, this bill doesn’t change anything when it comes to the “gun show loophole.” It just makes things that are already illegal double illegal. The same goes for domestic abusers and background checks. These laws already exist.

The “boyfriend loophole,” a clever phrase but not worded as such in the bill, does contain some alarming sentiments.

“SEC. 12005. (37)(A) The term ‘dating relationship’ means a relationship between individuals who have or have recently had a continuing serious relationship of a romantic or intimate nature.”

It is phrased loosely and unclearly. It allows lawyers to interpret the law however they see fit in a courtroom. Keep in mind that nothing in this bill would have prevented the shooting of Uvalde. He was 18 years old and had a rifle. He also had handguns, which are already illegal.

Kari Lake and President Trump have warned that new gun control measures will go against the Second Amendment. It will lead to guns being taken away from law-abiding citizens. Defending the second amendment is one of Lake’s core components of her platform.

As Lake has stated in regards to this new piece of legislation:

“I think I can speak for most Moms in America: you can shove your ‘Red Flag Laws’ where the sun don’t shine.”
